In brief

Divorce has different routes in Pakistan. A husband may pronounce talaq, a wife may hold a delegated right of divorce in the nikahnama, and a wife may seek dissolution through the Family Court. Section 7 of the Muslim Family Laws Ordinance 1961 requires notice to the Union Council Chairman.

We advise on the proper route and its consequences for dower, maintenance and children, and we make sure the paperwork leads to a valid divorce certificate.

Who this is for

Husbands and wives seeking to end a marriage, and overseas Pakistanis with a marriage registered in Karachi.

How we can assist

  • Talaq deeds and Section 7 notices
  • Delegated divorce (talaq-e-tafweez)
  • Dissolution suits in the Family Court
  • Union Council and divorce certificate procedure
  • Settlement of dower, dowry and maintenance

When clients come to us

  • The spouses agree to separate and want proper paperwork
  • A divorce was pronounced but never registered
  • One spouse is abroad
  • A wife wants to use her delegated right of divorce

How the matter moves

After a divorce is pronounced in writing, notice goes to the Union Council and the other spouse. The Council may attempt reconciliation, and the divorce generally takes effect after 90 days unless revoked. If a wife goes to court instead, the Family Court follows its own pre-trial and trial stages.

Papers to keep ready

  • Nikahnama
  • CNICs of both spouses
  • Children's details, if any
  • Any previous notices or settlement papers

Questions clients ask

Is verbal divorce enough?

The law requires notice to the Union Council. Skipping it creates problems later and can carry penalties, so it should be done properly.

How long does the process take?

The notice route generally runs for 90 days. Contested court cases depend on the Family Court's schedule and the issues involved.

Can divorce be handled from abroad?

Often yes, through properly attested documents or a power of attorney. We advise on what the Union Council will accept.
