In brief

Custody cases are heard by the Family Court acting under the Guardians and Wards Act 1890. The child's welfare is the deciding principle, and the court considers factors such as age, schooling, stability, and the conduct and circumstances of each parent.

We help parents present a practical case, seek meeting schedules where one parent lacks custody, and pursue urgent relief in cases of removal of a child.

Who this is for

Mothers, fathers and guardians involved in a dispute over a child's custody or access.

How we can assist

  • Custody and guardianship petitions
  • Visitation and meeting schedules
  • Return of a child taken without consent
  • Child maintenance claims
  • Guardianship certificates for minors' property or travel

When clients come to us

  • A parent has taken a child and stopped contact
  • A separated parent wants regular meetings
  • A mother is told she will lose custody on remarriage
  • A guardian is needed for a minor's property or travel

How the matter moves

A petition is filed in the Family Court, with the other parent given notice. The court may make interim orders about meetings or custody, record evidence, sometimes talk with the child, and then decide based on the child's welfare.

Papers to keep ready

  • Children's B-Form or birth certificates
  • Nikahnama and divorce papers, if any
  • School records and expense receipts
  • Evidence of the child's current care

Questions clients ask

Does the mother always get custody of young children?

Islamic law traditionally favours the mother for young children, but the deciding test is always the child's welfare, and each case depends on its facts.

Can the non-custodial parent meet the child?

Courts commonly grant visitation unless it would harm the child, and they can set a schedule.

Can a child be taken abroad during a dispute?

This can be restricted by court order and raises serious issues. Take advice immediately if you fear this is about to happen.
