In brief

Khula allows a wife to seek dissolution of her marriage through the Family Court. Under section 10 of the Family Courts Act 1964, if reconciliation fails at the pre-trial stage, the court can pass a decree for dissolution on the basis of khula.

The court may address the return of dower received, and related claims such as maintenance, dowry articles and custody can be considered. We explain each of these before you file.

Who this is for

Women seeking to end their marriage where the husband will not divorce, including overseas women.

How we can assist

  • Drafting and filing the khula suit
  • Attendance at reconciliation stages
  • Linked dower, dowry and maintenance claims
  • Custody claims alongside khula
  • Union Council procedure and divorce certificate

When clients come to us

  • The husband refuses to give a divorce
  • The husband has been abroad or missing for a long time
  • The wife has experienced mistreatment and wants to leave the marriage
  • A khula decree has been issued but no certificate obtained

How the matter moves

A suit is filed in the Family Court and notice is sent to the husband. The court attempts reconciliation, and if that fails, it may decree khula. The decree goes to the Union Council, and the certificate of divorce is obtained after the required period.

Questions clients ask

How long does khula take?

It can move relatively quickly compared with other litigation, but timing depends on service of notice, court schedule and linked claims.

Does the husband need to agree?

No, the court can decree khula even if he refuses, once reconciliation fails.

Will I lose my mehr?

The court may address dower you have received as part of the decree. Your position depends on your facts, so take advice first.
