In brief

The Protection against Harassment of Women at the Workplace Act 2010 requires organisations to have an inquiry committee and a code of conduct, and gives complainants access to the Ombudsperson. Following later amendments, the law's coverage has also widened.

We help complainants prepare a clear complaint and protect against retaliation, assist the accused in getting a fair hearing, and advise employers on policies and handling inquiries properly.

Who this is for

Employees facing harassment, persons accused of it, and organisations needing a compliant process.

How we can assist

  • Drafting and filing complaints
  • Ombudsperson proceedings
  • Representation before inquiry committees
  • Appeals against decisions
  • Employer policies and committee guidance

When clients come to us

  • A manager is making unwelcome advances or remarks
  • You are being punished after complaining
  • No committee exists at your workplace
  • An employer needs to deal with a complaint fairly

How the matter moves

A complaint can go to the internal inquiry committee or the Ombudsperson. Each side is given notice and a chance to respond, evidence is examined, and a decision is issued, which can include penalties. An aggrieved party may appeal within the time allowed.

Papers to keep ready

  • Dated account of each incident
  • Messages, emails and recordings
  • Witness names
  • Employment letter and company policy

Questions clients ask

Do I need to complain internally first?

You can usually choose between the internal committee and the Ombudsperson. We advise on which is better for your circumstances.

Will I lose my job if I complain?

Retaliation is a real concern, and it should be raised in the process. Keep records of any adverse action.

What if I am falsely accused?

You are entitled to notice and a fair chance to respond. Take advice before you respond.
