In brief

An appeal is not a retrial. It focuses on what went wrong with the decision below, based on the record and the law. Grounds have to be clear, and strict time limits apply under the Limitation Act 1908 and the relevant statutes.

We read the trial record closely, find the strongest points, file the appeal or revision, and apply to suspend the sentence or stay execution where justified.

Who this is for

Parties who have lost before a trial or appellate court, or a tribunal with an appeal to the High Court.

How we can assist

  • Civil appeals and revisions
  • Criminal appeals and sentence suspension
  • Stay of execution
  • Criminal miscellaneous applications
  • Appeals from special courts and tribunals

When clients come to us

  • A trial court decided against you on a wrong legal basis
  • A conviction needs an appeal and bail pending hearing
  • A decree-holder is executing and you need a stay
  • An appeal time limit is close

How the matter moves

We obtain certified copies of the judgment and record, calendar the deadline, and identify the legal and factual errors. The appeal is filed with any urgent application. It is then admitted, the record is called, and the case is argued at a regular hearing.

Papers to keep ready

  • Certified copy of the judgment or order
  • Pleadings and evidence from the trial
  • Earlier appeal papers
  • Any stay or bail order

Questions clients ask

How long do I have to appeal?

It depends on the type of order and statute. Limits can be short, so obtain the certified copy and take advice immediately.

Can new evidence be brought on appeal?

Only in limited circumstances. Appeals are generally decided on the existing record.

Can execution be stopped during the appeal?

Filing an appeal does not itself stay the order. A separate stay application is usually needed.
