In brief

Rent disputes in Karachi are generally governed by the Sindh Rented Premises Ordinance 1979 and decided by the Rent Controller. Landlords may seek ejectment on grounds such as default in rent, personal bona fide need or unauthorised subletting.

We act for both landlords and tenants, from the first notice through the ejectment application, any rent deposit orders, and appeal.

Who this is for

Landlords who want possession or unpaid rent, and tenants facing eviction or harassment.

How we can assist

  • Ejectment applications before the Rent Controller
  • Defence of tenants against eviction
  • Default in rent and rent deposit issues
  • Disputes over subletting and misuse of premises
  • Appeals and execution of ejectment orders

When clients come to us

  • The tenant has stopped paying rent
  • The owner needs the premises for personal use
  • A tenant is being pushed out without a court order
  • The premises have been sublet without permission

How the matter moves

The landlord files an application stating the ground for ejectment, and the tenant replies. The Rent Controller may make an interim order about rent payment, hears evidence and decides. An order can be appealed, and a final order can then be enforced through execution.

Papers to keep ready

  • Tenancy agreement, if any
  • Rent receipts or bank transfer records
  • Ownership documents for the premises
  • Notices exchanged between the parties

Questions clients ask

Can a landlord remove a tenant without going to court?

Generally not. A tenant should be removed through the legal process, and forced removal can create legal problems for the landlord.

What if there is no written rent agreement?

A tenancy can still be proved through other evidence, such as receipts and bank records. A written agreement simply makes matters easier.

Can a tenant deposit rent in court?

There are provisions for depositing rent when a landlord refuses it. Doing this correctly matters, because a mistake can be treated as default.
